Business Terms

These Business Terms apply to local businesses using Asku.

1. About these Terms

These Terms govern your use of Asku as a provider (a local business receiving enquiry alerts and unlocking customer contact details).

They do not apply to customers using Asku to submit an enquiry. Customer use is covered by the customer Terms of Use and Privacy Policy.

If you do not agree to these Terms, you must not use Asku as a provider.

Nothing in these Terms is intended to exclude or limit rights that cannot lawfully be excluded or limited.

2. Who Asku is

Asku operates a WhatsApp-first matching service. Customers describe what they need. Asku may notify relevant local businesses and allow those businesses to unlock the customer’s contact details for that enquiry.

Asku is not the contractor. Asku does not carry out the underlying work. Any contract for the actual service is between you and the customer, if you both choose to proceed.

Asku does not verify, vet, approve, certify, insure or recommend providers unless we expressly say so in writing for a specific check. The current service does not perform those checks.

3. Acceptance of these Terms

By completing provider onboarding and using Asku as a provider, you accept these Terms.

When WhatsApp onboarding includes a confirmation step that shows a link to these Business Terms, you accept these Terms by replying I AGREE as part of that required confirmation. We may record:

  • your provider account identity
  • the Business Terms version you accepted
  • the time of acceptance

If you send a different reply at that step, onboarding may not complete until you confirm, or we may treat a new coverage reply as a change to coverage rather than acceptance.

If we publish a new version of these Terms, we will show the updated version on this page. For material changes we may ask you to accept the new version before you continue to receive alerts or unlock enquiries. Continued use after we notify you of updated Terms may also constitute acceptance, except where the law requires a more specific consent.

4. The Asku service

Asku may:

  • receive customer enquiries via WhatsApp
  • process those enquiries (including automated processing)
  • send you WhatsApp alerts for enquiries that appear to match your chosen service categories and coverage
  • allow you to view a summary of an enquiry and choose whether to unlock the customer’s contact details
  • charge the applicable unlock fee when you choose to unlock an enquiry after any applicable first free unlock, with the fee shown before payment

Asku does not guarantee:

  • a volume of alerts
  • that an alert will be sent to you
  • uninterrupted availability
  • that a customer is still available, still wants the work, or will reply

Matching is based on information you supply (including category and coverage) and information extracted from the customer enquiry. Matching is not a quality, insurance or qualification check.

5. Provider eligibility and responsibilities

You must be legally entitled to offer the services you select on Asku.

You are responsible for holding and maintaining, where applicable:

  • licences
  • qualifications
  • professional registrations
  • insurance
  • tax registrations and tax compliance
  • DBS or other safeguarding checks where legally or professionally required
  • permissions needed to carry out the work

You warrant that the information you give Asku (including business name, services and coverage) is accurate and kept reasonably up to date.

Asku does not currently verify these matters. Listing on Asku, receiving an alert, or unlocking an enquiry is not a representation by Asku that you are insured, qualified, approved or suitable for any particular job.

If you cannot lawfully or professionally perform work of the type you selected, you must not unlock related enquiries.

6. Enquiries, matching and alerts

Customers submit enquiries through WhatsApp. Asku may use automated tools to interpret category, location, urgency and a short summary.

Urgency labels such as HIGH, STANDARD and LOW are Asku pricing and matching classifications. They do not mean:

  • emergency dispatch
  • a guaranteed immediate response
  • that you are an emergency service

If a situation requires the emergency services or a specialist emergency provider, that is a matter for the customer and the appropriate emergency service. Asku is not an emergency response service.

Alerts are typically sent to providers whose active account, set coverage, and service category match the enquiry. You may receive alerts whether or not you have previously unlocked an enquiry or made a payment. Receiving an alert does not require you to unlock.

Reply STOP on WhatsApp to stop job alerts. That is an alert preference. It is not, by itself, termination or deletion of your provider account.

Reply START (or the prompt we send) if you want alerts again, subject to these Terms and your account status.

7. Unlocking customer contact details

You may open an enquiry from an alert link, review the details shown, and see the cost to unlock before you confirm.

If you unlock:

  • Asku reveals the customer’s contact details for that enquiry, as available at that time
  • for a paid unlock, you pay the applicable unlock fee shown before payment; payment is required before access to the customer’s contact details for that paid unlock, except where a first free unlock still applies and is shown as free
  • up to three providers may unlock the same enquiry
  • unlocking is not exclusive

You should only unlock if you intend to contact the customer about that enquiry.

8. What you are buying — and what you are not

When you unlock, you purchase access to the customer’s contact details for that enquiry (and the enquiry summary then shown).

You do not purchase:

  • a guaranteed job
  • exclusivity
  • a guaranteed customer response
  • a guaranteed booking or instruction
  • a completed job
  • a particular job value
  • a particular conversion rate
  • a guarantee that the customer has not changed their mind
  • a guarantee that you are suitable for the work

If you and the customer proceed, any contract for the work is between you and the customer. Asku is not a party to that contract.

9. Pricing and first unlock

There is no monthly subscription for receiving alerts.

You pay only if you unlock an enquiry (except any first free unlock that is shown as free at the time of unlock).

Unlock prices may depend on the enquiry’s Asku urgency classification and are shown on the unlock page before you confirm. The price shown at the time you unlock is the price that applies to that unlock.

For paid unlocks, payment is made when you choose to unlock the enquiry, using the payment process shown on the unlock page.

Asku currently offers a first free unlock for a provider account (shown as free on the unlock page until it has been used). Promotional offers, including a first free unlock, may be changed prospectively. They do not apply retrospectively to completed paid unlocks.

Asku may change future unlock prices. Price changes apply prospectively. Completed unlocks are not retrospectively repriced.

10. Lead Access Error Resolution

Asku does not operate a general refund programme for unlocks.

Once you have legitimately unlocked and received the access offered for that enquiry, normal commercial disappointment is not grounds for reimbursement. That includes, without limitation:

  • the customer does not respond
  • the customer changes their mind
  • the customer has already hired someone else
  • the customer chooses another provider
  • you cannot agree a price
  • a quote is rejected
  • you decide you do not want the work
  • the work is too small or too difficult for you
  • you are unavailable
  • you consider the enquiry poor quality

Lead Access Error Resolution is a narrow internal review for genuine Asku platform errors attributable to Asku, for example:

  • a duplicate charge caused by an Asku system error
  • you were charged but the purchased access was not made available because of an Asku technical fault
  • a technical processing failure that prevented the access you purchased
  • a material platform or routing error attributable to Asku

Review is not an automatic promise of reimbursement. Asku may request evidence. Where Asku accepts that a platform error occurred, Asku may offer a remedy it considers appropriate in the circumstances, for example a refund of the relevant unlock payment through the original payment method or another appropriate remedy. Other remedies may be used where appropriate.

This process does not affect rights you have that cannot lawfully be excluded.

To request a review, email info@asku.co.uk with the enquiry / unlock reference and a short description of the platform error. Do not use this process for ordinary conversion disappointment.

11. Customer information and data protection

If you unlock an enquiry, you may use the customer’s contact details only to respond to that specific enquiry.

You must not:

  • use the details for unrelated marketing
  • add the customer to a marketing list without a lawful basis independent of Asku
  • sell customer information
  • share customer information except as needed to perform that enquiry (for example a colleague doing that job) or as required by law
  • use the information for unrelated purposes
  • harass, threaten or unreasonably repeatedly contact the customer
  • impersonate Asku or misrepresent that you are employed or endorsed by Asku

Once you receive customer information, you are responsible for complying with applicable data protection law in your handling of that information (for example how you store numbers on your phone or in your systems). Asku remains responsible for personal data it controls in operating the Asku platform, as described in the Privacy Policy. These Terms do not transfer Asku’s own controller duties to you.

Access to customer contact details through Asku is not permanent. See section 15.

12. Provider conduct and prohibited use

You must not:

  • submit false business information
  • create multiple accounts to circumvent limits, promotions, STOP, suspension or payment rules
  • circumvent payment, unlock or platform controls
  • abuse alerts, unlocks, payments or any payment facilities made available
  • use Asku in connection with unlawful activity
  • scrape, harvest or bulk-export customer details beyond the enquiry you unlocked

Asku may investigate suspected misuse.

13. Coverage, STOP and availability

You control the coverage you set. We aim to send relevant local alerts, but we do not guarantee relevance, delivery or volume.

STOP stops job alerts. It is not deletion of your account.

Asku may be unavailable from time to time. We do not guarantee uninterrupted service.

14. Suspension and termination

Asku may pause, suspend or terminate provider access where reasonably necessary, including for:

  • fraud or suspected fraud
  • misuse
  • harassment
  • unlawful conduct
  • abuse of customer information
  • circumvention
  • multiple accounts
  • payment abuse
  • material or repeated breach of these Terms

Immediate suspension may apply where reasonably needed to protect customers, other providers, Asku or the platform.

15. Retention and end of access to enquiry data

Asku retains customer enquiry data only for a limited period after an enquiry closes or expires, and as described in the Privacy Policy.

After that period, Asku may anonymise or delete customer contact details and related enquiry content. If you unlocked an enquiry, later visits to the same unlock link may no longer show the customer’s number or full job details.

You should save, by lawful means, only what you still need for that enquiry (for example if the customer has already instructed you). Asku is not obliged to keep contact details available indefinitely after unlock.

16. Changes to prices, service and these Terms

Asku may change the service, matching rules, promotional offers and future unlock prices.

Completed unlocks are not retrospectively repriced.

Updated Terms will be published on this page with a version and date. See section 3 on acceptance of new versions.

17. Liability

Asku is provided on a practical, best-effort basis.

To the fullest extent permitted by law, Asku is not liable for:

  • lost work, profit or opportunity
  • customer decisions, including not to reply or not to hire you
  • failed contacts after details were made available
  • the quality, safety or lawfulness of work you or any other provider carry out
  • indirect or consequential losses

Asku remains responsible for loss caused by Asku’s own negligence or other liability that cannot legally be excluded, and for genuine platform errors handled under Lead Access Error Resolution where Asku accepts that an Asku fault occurred.

Nothing in these Terms excludes liability that cannot legally be excluded.

Disputes about quotes, workmanship, delays or the job itself are between you and the customer, except where the issue is an Asku platform error as described above.
